The Cabinet of Ministers of Ukraine has charged the Ministry of Energy and Coal Industry of Ukraine with creating an inter-agency commission for investigating the systematic non-compliance by NJSC Naftogaz of Ukraine with the plan for transfer of assets, material and technical and other resources required for effective operation of PJSC Main Gas Pipelines of Ukraine.
The relevant decision was passed at the government session on the basis of the report of Ihor Nasalyk, Minister of Energy and Coal Industry of Ukraine.
The inter-agency commission has to comprise representatives from the Secretariat of the Cabinet of Ministers of Ukraine, Ministry of Justice of Ukraine, and the General Prosecutor's Office of Ukraine. It is planned to consider the report on the investigation results at a government session and pass subsequent relevant decisions.
According to Ihor Nasalyk, on June 14, 2017, the Cabinet of Ministers of Ukraine has supported the analysis of the material and technical, human and other resources required for effective operation of PJSC Main Gas Pipelines of Ukraine.
Furthermore, a preliminary list of assets, material and technical and other resources required for effective operation of PJSC Main Gas Pipelines of Ukraine, and a plan of their transfer to the said company were prepared as developed by the Ministry of Energy and Coal Industry of Ukraine with the participation of experts from the Secretariat of the Energy Community.
NJSC Naftogaz of Ukraine has presented the list of assets which is absolutely different from the one approved by the protocol resolution of the Government. This list of assets has not been agreed with the Secretariat of the Energy Community, as required by clause 4 of Resolution No. 496 of the Cabinet of Ministers of Ukraine, dated July 1, 2016.
As a result, the Ministry of Energy and Coal Industry of Ukraine may not approve the submitted list of assets, in pursuance of clause 6 of the annex to the asset transfer plan. Therefore, such acts of NJSC Naftogaz of Ukraine, in fact, sabotage the implementation of Resolution No. 496 of the Cabinet of Ministers of Ukraine.
The abovementioned circumstances cause the breakdown in the restructuring process of the PJSC by NJSC Naftogaz of Ukraine in order to separate the natural gas transportation activities, and the Ukrainian party's failure to comply with its obligations undertaken before the European Community.
