The court sided with the state in the Ukrtatnafta case
The legality of the forced alienation of shares of the enterprise has been recognized
The Supreme Court confirmed the legality of the state's actions regarding the forced alienation of shares of PJSC "TFPNK "Ukrtatnafta" under martial law. This was reported by the press service of the Ministry of Justice.
"The court dismissed the cassation appeal of Relix Services Ltd. The decisions of the courts of first and appellate instances to refuse to satisfy the claim were left unchanged. The court confirmed that the forced seizure of Ukrtatnafta shares took place on legal grounds: in accordance with the decision of the military command and the provisions of the Law "On the Transfer, Forced Alienation or Seizure of Property under the Legal Regime of Martial Law or a State of Emergency," the report says.
The Supreme Court noted that this case is one of many in which companies associated with former owners of corporate rights to strategically important enterprises are challenging the state's actions to alienate shares.
The alienation of corporate rights of PJSC "Ukrnafta" and PJSC "TFPNK "Ukrtatnafta" became a necessary step to ensure defense capability, stability of the fuel market of Ukraine, and the safety of citizens in conditions of full-scale war.
"As of June 2025, there are 13 cases pending in the courts of Ukraine, in which the Cabinet of Ministers of Ukraine is a participant (the procedural representative is the Ministry of Justice) and 2 cases in which the state, represented by the Ministry of Justice, is the defendant. In all of these cases, decisions have been made to dismiss the claim. In addition, the Supreme Court has issued final court decisions in 14 court cases," the report says.
As Ukrainian Energy reported, in May 2025, businesses received UAH 252 million in loans for energy infrastructure restoration projects, and the population was provided with UAH 110 million in loans for energy needs.
